Deputy Attorney-General and Minister for Justice, Justice Srem Sai, has announced that the Office of the Attorney-General will take steps to assume control of cases currently being prosecuted by the Office of the Special Prosecutor, in compliance with a recent High Court ruling.
The directive follows a legal challenge initiated by Peter Archiblod Hyde, who questioned the authority of the OSP to prosecute cases without prior approval from the Attorney-General.
According to Dr. Srem Sai, court proceedings revealed that the OSP was unable to demonstrate that it had obtained the required authorisation before initiating prosecutions. This led the High Court to direct that such cases be handled by the Attorney-General until the issue is resolved.
The applicant’s legal team argued that both the Constitution and the OSP Act mandate prior approval for prosecutions, a position the court upheld in its ruling.
Commitment to Rule of Law
Dr. Srem Sai stressed that the Attorney-General’s office will comply fully with the court’s directive, reaffirming its commitment to the rule of law and judicial authority.
“Accordingly, the Office of the Attorney-General will, in the coming days, begin to take the necessary steps to give effect to the Court’s order,” he stated.
He added that processes are being initiated to ensure a smooth transition of affected cases, as authorities work to align prosecutorial procedures with constitutional requirements.
