The Accra High Court has affirmed the Ghana Shippers’ Authority’s power to enforce regulatory directives, ordering MSG Freight and Cargo Services to comply with a Ghana Shippers Authority refund directive over excess storage charges.
The ruling, delivered on July 8, 2026, arose after the shipping service provider failed to apply the applicable commercial exchange rate of its bankers when calculating charges for a shipper.
According to the GSA, the error resulted in the shipper paying more than the amount due.
The Authority subsequently directed MSG Freight and Cargo Services, a consolidator, to refund the excess amount. The company did not comply, prompting the regulator to seek enforcement before the High Court.
Court Backs GSA Regulatory Powers
In Ghana Shippers’ Authority v Maxwell Edzeame, Proprietor of MSG Freight & Cargo Services, the court ordered the company to comply with the refund directive in line with Section 47 of the Ghana Shippers’ Authority Act, 2024, Act 1122.
The GSA said the judgment reinforces its authority to regulate commercial shipping activities and protect shippers from charges that do not comply with statutory requirements.
It also puts service providers on notice that regulatory directives issued under Act 1122 are enforceable.
GSA Warns Shipping Service Providers
Following the ruling, the Authority urged companies operating in Ghana’s shipping and logistics sector to ensure that their charges and commercial practices conform with applicable regulations.
Where a service provider imposes charges contrary to regulatory requirements, the GSA said it would take the necessary enforcement action.
The Authority said it remains committed to “transparency, predictability, fairness and consistency” in shipping and logistics transactions.
The decision strengthens the GSA’s position as regulator of Ghana’s commercial shipping sector and gives shippers a clearer route for challenging charges found to be inconsistent with approved rules.
