Ghana’s Court of Appeal has dismissed an application by lawyers for Bernard Antwi Boasiako seeking to halt his ongoing criminal trial at the High Court in the Samreboi mining case.
The decision, delivered on Tuesday, April 21, 2026, marks a significant setback for the defence, which had attempted to suspend proceedings pending the outcome of an interlocutory appeal.
The application challenged an earlier ruling by Audrey Kocuvie-Tay, which ordered the accused to open his defence over allegations that he permitted unauthorised mining activities on his concession.
However, the appellate court held that the request failed to establish “exceptional circumstances” required to justify halting the trial, effectively clearing the way for proceedings to continue at the High Court.
With both the High Court and the Court of Appeal rejecting the request, the substantive criminal case remains active. The High Court is now expected to proceed with the next phase unless further legal intervention is secured.
Counsel for Chairman Wontumi indicated that the legal team is reviewing its options following the ruling. Possible next steps include escalating the matter to the Supreme Court of Ghana or proceeding with opening the defence as directed.
The latest development underscores the court’s position that the trial should move forward without delay, keeping the spotlight on the high-profile Samreboi mining case.
